Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "user") and SignOut LLC, a Montana limited liability company ("we," "us," "our," or "SignOut"), regarding your access to and use of the Squishy School web application, iOS application, Android application, and any related services, APIs, or content (collectively, the "Service").
By creating an account, downloading our mobile application, or otherwise accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, do not use the Service.
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date and notify you via email or in-app notification. Your continued use of the Service after such notification constitutes acceptance of the modified Terms. If you do not agree to modified Terms, your sole remedy is to stop using the Service and delete your account.
2. Eligibility
You must be at least 13 years of age (or 16 years of age if you reside in the European Economic Area or United Kingdom) to create an account and use the Service. By creating an account, you represent and warrant that you meet the applicable age requirement.
If you are between the ages of 13 and 18 (or the age of majority in your jurisdiction), you represent that you have the consent of a parent or legal guardian to use the Service, and that your parent or legal guardian has read and agreed to these Terms on your behalf.
3. Description of Service
Squishy School is an educational platform designed for nursing, medical, and health science students. The Service provides:
- AI-powered question and flashcard generation from user-uploaded content (PowerPoints, PDFs, images, audio recordings).
- Practice question banks for professional exams (NCLEX, USMLE, PANCE, ANCC, AANP, and others).
- Gamification features including XP, streaks, badges, leaderboards, and daily login rewards.
- Live multiplayer study group sessions with real-time scoring.
- Discussion forums for questions and class sections.
- Flashcard study sessions with spaced repetition.
- Critical thinking and clinical reasoning content for nursing students.
We may add, modify, or discontinue features of the Service at any time. We will make reasonable efforts to notify users of significant changes.
4. Account Registration and Security
- You must provide accurate, current, and complete information during registration (including your real first name, last name, and a valid email address).
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
- You may not share your account with others, create multiple accounts, or transfer your account to another person.
- You must immediately notify us at support@squishyschool.com if you suspect unauthorized access to your account.
- We may enforce single-session login (one device at a time) and will notify you if your session is terminated due to a login on another device.
5. Subscription Tiers, Payments, and In-App Purchases
5.1 Subscription Tiers
The Service offers three subscription tiers with different feature access levels:
- Free: Generate up to 5 AI questions per day (50 per month), unlimited practice from the existing question bank, view flashcards (no study sessions), preview discussions, 1 study group session per month, XP/streaks/leaderboards.
- Plus ($1.99/month or $19.99/year): Generate up to 15 AI questions per day (150 per month), full flashcard study sessions, post/reply/vote in discussions, 3 study group sessions per month, no ads.
- Pro ($4.99/month or $49.99/year): Generate up to 50 AI questions per day (500 per month), everything in Plus, pro-level explanations, unlimited study group sessions, 2x daily login rewards, no ads.
Generation limits refer to AI-generated questions from your uploaded content. Answering questions from the existing question bank is unlimited on all tiers.
5.2 In-App Purchases
Subscriptions are purchased exclusively through in-app purchases on the Apple App Store (iOS) or Google Play Store (Android). All billing, payment processing, and refunds are handled by Apple or Google according to their respective terms of service. SignOut LLC does not directly process credit card payments for subscriptions.
5.3 Billing and Renewal
- Subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date.
- You will be charged through your Apple ID or Google Play account.
- Price changes will be communicated in advance. Your continued subscription after a price change constitutes acceptance of the new price.
5.4 Cancellation and Refunds
- You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings.
- Cancellation takes effect at the end of the current billing period. You retain access to paid features until that date.
- Refunds are governed by the refund policies of Apple or Google, as applicable. We do not provide direct refunds unless required by law.
- If you believe you were charged in error, contact support@squishyschool.com and we will assist you.
5.5 Free Trials
We may offer free trial periods for paid tiers. Trial terms will be disclosed before you start the trial. Unless you cancel before the trial ends, your subscription will automatically convert to a paid subscription at the stated price.
6. Acceptable Use
You agree to use the Service only for lawful, educational purposes. You may not:
- Share your account credentials with others or allow unauthorized access to your account.
- Use the Service to cheat on official licensure examinations, certification exams, or academic assessments, or to violate any academic integrity policy of your educational institution.
- Post or transmit content that is harmful, abusive, threatening, defamatory, obscene, hateful, discriminatory, or otherwise objectionable in discussion forums, study groups, or any other part of the Service.
- Upload content that you do not have the right to distribute (e.g., copyrighted materials you do not own or have permission to use).
- Upload content that contains malware, viruses, or any harmful code.
- Attempt to reverse-engineer, decompile, disassemble, or extract source code from the Service or its underlying software.
- Use automated tools, bots, scrapers, crawlers, or similar mechanisms to access the Service or extract content.
- Interfere with or disrupt the Service, its servers, or connected networks.
- Impersonate another person, misrepresent your identity, or create a false or misleading profile.
- Use the Service for any commercial purpose not expressly authorized by us.
- Circumvent, disable, or otherwise interfere with any security features of the Service, including subscription tier enforcement.
- Engage in any activity that violates applicable local, state, national, or international law.
We reserve the right to investigate violations of these rules and to suspend or terminate accounts at our sole discretion, with or without notice.
7. User-Generated Content
7.1 Your Content
You retain ownership of any content you create and post through the Service, including discussion posts, comments, replies, and files you upload for question generation ("Your Content"). By posting or uploading Your Content, you grant SignOut LLC a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, display, and distribute Your Content solely for the purpose of operating, improving, and providing the Service.
7.2 Content Moderation
We reserve the right (but have no obligation) to review, remove, or disable access to any user-generated content that we determine, in our sole discretion, violates these Terms or is otherwise harmful or inappropriate.
7.3 AI-Generated Content
Questions, flashcards, explanations, and other educational content generated by our AI systems from your uploaded materials are derived works. You may use this generated content for your personal study purposes. You may not commercially redistribute AI-generated content from the Service without our prior written consent.
8. Medical and Educational Disclaimer
IMPORTANT: READ THIS SECTION CAREFULLY.
- All questions, explanations, case studies, flashcards, critical thinking content, and other educational materials provided through the Service are generated using artificial intelligence and are intended solely for study and practice purposes.
- The Service and its content do not constitute medical advice, clinical guidance, nursing diagnosis, patient care recommendations, or a substitute for professional medical judgment.
- AI-generated content may contain errors, inaccuracies, or outdated information. You should not rely on Squishy School content to make clinical decisions or patient care choices.
- Always consult qualified healthcare professionals, authoritative clinical references, current practice guidelines, and your educational institution's approved materials for patient care decisions.
- We make no warranties regarding the accuracy, completeness, currency, or clinical applicability of any content provided through the Service.
- SignOut LLC, its officers, employees, and agents shall not be liable for any harm arising from reliance on content provided through the Service in a clinical or patient care setting.
9. Intellectual Property
- The Service, including all software, design, branding, logos (including the Squishy School mascot), user interface, text, graphics, and other content created by us, is owned by SignOut LLC or its licensors and is protected by copyright, trademark, trade dress, patent, and other intellectual property laws.
- The "Squishy School" name and logo are trademarks of SignOut LLC. You may not use our trademarks without prior written permission.
- You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, or otherwise exploit any part of the Service without our prior written consent, except as explicitly permitted by these Terms.
- We respect the intellectual property rights of others. If you believe that content on the Service infringes your copyright, please contact us at support@squishyschool.com with details of the alleged infringement.
10. Account Deletion and Termination
10.1 Voluntary Deletion
You may delete your account at any time by using the account deletion feature within the app (Settings > Delete Account), or by emailing support@squishyschool.com. Upon deletion:
- Your personal data will be removed from active production systems within 30 days.
- Your data may persist in encrypted backups for up to 90 days before permanent purging.
- Discussion posts and comments you made may be retained in anonymized form (author shown as "Deleted User").
- Account deletion does not automatically cancel an active subscription. You must cancel your subscription separately through the Apple App Store or Google Play Store.
10.2 Termination by Us
We may suspend or terminate your account at our sole discretion, with or without notice, for conduct that we determine violates these Terms, is harmful to other users or the Service, or is otherwise inappropriate. We may also terminate accounts that have been inactive for more than 24 months. Upon termination, your right to use the Service ceases immediately.
10.3 Effect of Termination
Upon termination for any reason, the following sections of these Terms survive: Sections 7 (User-Generated Content licenses), 8 (Medical Disclaimer), 9 (Intellectual Property), 11 (Limitation of Liability), 12 (Disclaimer of Warranties), 13 (Indemnification), and 14 (Governing Law and Dispute Resolution).
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:
- SIGNOUT LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, INTERRUPTION OF SERVICE, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE ACTUALLY PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
- SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT AVAILABLE THROUGH THE SERVICE, INCLUDING AI-GENERATED CONTENT.
13. Indemnification
You agree to indemnify, defend, and hold harmless SignOut LLC and its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property, privacy, or proprietary right; or (d) any content you upload, post, or transmit through the Service.
14. Governing Law and Dispute Resolution
14.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Montana, United States, without regard to its conflict of law provisions.
14.2 Informal Resolution
Before filing any formal legal proceeding, you agree to first attempt to resolve any dispute informally by contacting us at support@squishyschool.com. We will attempt to resolve the dispute informally within 60 days.
14.3 Jurisdiction and Venue
If informal resolution is unsuccessful, any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in the State of Montana, and you consent to the personal jurisdiction of such courts.
14.4 Class Action Waiver
TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY CLAIMS OR DISPUTES ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY AND NOT AS PART OF ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
15. Third-Party Services and Links
The Service may contain links to or integrations with third-party websites, applications, or services (including Apple App Store, Google Play Store, and payment processors). We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of third-party services is governed by their respective terms and policies.
16. Apple and Google App Store Terms
If you access the Service through a mobile application downloaded from the Apple App Store or Google Play Store, the following additional terms apply:
- These Terms are between you and SignOut LLC only, not with Apple Inc. or Google LLC. Apple and Google have no obligation to provide maintenance or support for the Service.
- Apple and Google are not responsible for any claims related to the Service, including product liability claims, consumer protection claims, or intellectual property infringement claims.
- Apple and Google are third-party beneficiaries of these Terms (to the extent applicable to their respective app store) and may enforce these Terms against you as a third-party beneficiary.
- You represent that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
17. Push Notifications
With your permission, we may send push notifications to your mobile device. These notifications may include study reminders, streak alerts, study group invitations, badge awards, login reward reminders, and service announcements. You may opt out of push notifications at any time by adjusting your device settings. Opting out of push notifications does not affect your ability to use the Service.
18. Referral Program
We may offer a referral program that rewards users for referring new users to the Service. Referral rewards are subject to the specific terms of the referral program as published within the Service. We reserve the right to modify, suspend, or terminate the referral program at any time. Referral abuse (including self-referrals, fake accounts, and fraudulent activity) may result in forfeiture of earned rewards and account termination.
19. Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
20. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and SignOut LLC regarding your use of the Service. These Terms supersede all prior agreements, representations, and understandings, whether written or oral, relating to the subject matter herein.
